In the last year alone: - 30+ U.S. states have introduced or passed legislation targeting deepfakes and AI impersonation - The EU AI Act now explicitly regulates synthetic media and requires disclosure for AI-generated content - Several U.S. states, including California and Texas, have passed laws criminalizing certain forms of AI impersonation and election-related deepfakes Why the sudden urgency? AI has fundamentally changed the economics of deception. The same tools that help brands create content and scale marketing can now generate: - realistic fake videos - synthetic voice calls - AI-generated product images - counterfeit listings and look-alike storefronts This week I spoke with Woman’s World about how consumers can spot AI scams, from deepfake videos, to counterfeit products, and synthetic product photography -- because sadly, the burden is getting heavier for them to spot the fakes before it's too late. Mark I. Lee ⚡ shared thisIt’s not often that the New York Times writes an excellent in-depth piece about the exact industry I spend my waking hours thinking about. But when it does, it’s striking how closely it mirrors what we see every single day. At a high level, Rose Maura Lorre, the reporter, set out to answer a simple question: If you buy a popular beauty product online, how sure are you that it’s real? Spoiler alert: In the end, all 12 products that she purchased from third-party sellers were determined to be counterfeit. When I read the piece, I couldn’t help but take screenshots on my phone (see below). Because the diagrams and testing notes are essentially a public version of what our teams see every day in the field. The article describes the confusing supply chain behind third-party marketplaces: Authorized manufacturers → authorized sellers → returns → liquidation warehouses → brokers → unauthorized sellers → marketplaces. That complexity is exactly why our MarqLaw legal services team spends so much time investigating seller networks and taking down the real people behind these shadow networks. Often it’s not a single rogue listing but an entire ecosystem. Once a brand launches — especially in beauty — marketing can drive explosive demand overnight. But if protection isn’t part of the launch strategy, the same growth engine that builds the brand can also fuel an entire shadow supply chain around it. In fact, we found that nearly 60% of brands are spotting fakes of their products within one week of a viral moment. For emerging beauty brands and global ones alike, this NYT investigation is an excellent primer on a reality many founders only discover the hard way: It's not about *if* your brand will be copied. It’s about if your brand is ready when it does.

We talked about my experiences growing up in Korea, moving to the U.S. at 16, studying at Harvard University, and how an early obsession with the criminal counterfeit industry and problem solving eventually led to building MarqVision. What I appreciate most about conversations like this is the reminder that none of it was linear: Law → consulting → startup operator → founder. Each step felt uncertain at the time. In hindsight, it all makes sense. We also unpacked why I chose to focus on counterfeiting, a $3T global problem, and how AI can automate 30–40% of the manual enforcement work brands are buried in today. Grateful to Cameron for creating space for a real conversation about risk, conviction, and building in a category most people overlook. It was also an important one for the European Football Clubs Brand Protection Service as for the first time, we brought together our key partners, stakeholders and Member Clubs to exchange views in person. I am especially grateful to our panelists and the EFC Brand Protection Task Force who came to support us and participate in the conversation about brand protection in football. (JDSUPRA) California is once again at the forefront of privacy regulation, this time with a sharp focus on the insurance sector. California’s proposed Senate Bill 354, styled as the Insurance Consumer Privacy Protection Act of 2025 (the “ICPP Act” or the “Act”), would, if enacted, introduce an augmented privacy regime for the insurance sector. Its advocates claim the ICPP Act goes beyond the protections found in California’s current consumer privacy laws, including the California Insurance Information and Privacy Protection Act (the “IIPPA”) and the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, “CCPA”). What You Need To Know 🔹 A proposed California law is poised to increase the state insurance market’s transparency and accountability. 🔹 The Insurance Consumer Privacy Protection Act would impact tech companies who provide services to insurers, because it applies to insurance licensees and their third-party service providers. 🔹 Tech companies in this space should consider reviewing policies for clear and conspicuous privacy notices, consumer consent, data minimization and retention, oversight of third-party service providers, prohibition on the sale of personal information, and consumer rights. Earlier this month, the California Senate unanimously passed Senate Bill 690 (SB 690) in a 35-0 vote, a strong show of support for reining in a flood of lawsuits that have taken many companies by surprise over the last few years. The bill now heads to the California Assembly, where it will face further scrutiny. If ultimately signed into law, SB 690 could reshape how privacy law is enforced in the digital space, offering much-needed clarity (and relief) for businesses across the country. The 23andMe saga is likely to accelerate an ongoing trend of smaller companies and startups proactively securing broader data permissions and explicitly delineating how consumer data will be treated in a sale or merger. “Traditionally … startups, they weren't putting as much money into privacy compliance,” said Tyler Thompson, a partner at Reed Smith. “We're starting to see folks realize … going through the diligence process to get an exit or to get additional funding, these data issues, privacy, security are starting to hold that up.” Events like the 23andMe bankruptcy, where a potential asset sale can be complicated by the lack of data privacy and monetization policies sough by the acquiring party, have served to catalyze the change, and placed a particular emphasis on how personal data will be treated in any sale process. While many asset sales do not rise to the level of public attention the 23andMe bankruptcy has attracted, companies and lawyers have seen more sales, investments and bankruptcy processes held up and prices impacted due to privacy policies and consents. While federal bankruptcy law and state-level privacy laws do address how data protections should be maintained in sale processes, the lack of clarity in these laws puts the onus on companies to craft and uphold polices on their own.
