The Court reasoned that neither the attorney-client privilege, nor the work-product doctrine protects information generated or transmitted in these circumstances. This decision is one of several emerging rulings that will begin to shape how the practice of law intersects with AI technology moving forward.

Larry Sands posted thisFive Ways to Catch ChatGPT, Gemini, Claude and Perplexity’s “Eyes” How do you get ChatGPT, Claude, Perplexity, and Gemini to notice your company? LLMs are already replacing traditional search. Instead of Googling “best zero-turn mower,” people now ask: “Acting as a professional landscaper who maintains large lawns, help me choose which zero-turn mower I should buy…” And they’re making real buying decisions based on the results. So how do you get these AI engines to see your business as credible, relevant, and recommendable? Each one uses a different mix of inputs, but there are some commonalities. While the weight/importance may vary, here are five things your team can start doing today: 1. Awards, Affiliations & Accreditations Won a “Best of” award? Feature it prominently on your website. Member of your local Chamber? Say so. Got press from the local business journal? Add “As seen in the Charlotte Business Journal” to your site. Also include BBB accreditations, trade group memberships, Google review badges (“Rated 4.8 Stars on Google”), and even local sponsorships and nonprofit recognitions. These all help LLMs identify and validate your legitimacy. 2. Get Positive Online Reviews Put a system in place to drive consistent 4+ star reviews. While not a panacea, early indicators suggest that businesses with less than 3.5 stars are far less likely to be recommended by AI engines. 3. Increase Google Website Authority Claude may be the exception here, but for the others, Google’s assessment of your business — through domain authority, business profile completeness, and review volume — is a major signal. This takes time and strategy, but there are solid how-to guides available as well as experts who focus on this everyday. Hire them. 4. Monitor Social Media & Sentiment Right now, ChatGPT is the only one using real-time social sentiment — but with its ~60% share of the AI search market, that’s significant. Tools like Sprout Social, Brand24, Meltwater, and Hootsuite can help you track brand mentions and perception. 5. Get into Traditional Databases & Directories This one’s especially key for Claude. LLMs draw from Wikipedia, Britannica, The Wall Street Journal, The New York Times, and more. Make sure you have a Wikipedia entry — and keep it up to date. Also, business-specific databases like Bloomberg and Hoovers carry heavy weight for Claude. You can knock out most of these with a coffee and an hour a day. Focus on one at a time, and in a week, your business won’t just show up — it will start standing out. If you do the work now, the next time someone asks their AI assistant for a recommendation, your business will be what it sees.

Frits and I did tours together at both LendingTree and Experian spanning the past decade and met in CLT as potential new strategic partners in our respective roles at FICO and Credit Sesame. Yes Virginia, Relationships Still Matter, and I’d argue even more so now in this rapidly evolving world being disrupted by AI. So pick up the phone and schedule some actual face time with someone you’ve been missing. I guarantee you’ll enjoy the experience a heckuva lot more than a video call or a text message and a cold brew and sushi paired with smart conversation is impossible to beat!

I left with multiple things I changed in my delivery thereafter. Atul Gawande is one of the best surgeons in the world. Eight years into operating, he hired a coach. Not because he was failing. Because he'd stopped improving and nobody was telling him why. That's what Chicago was for me. Not a conference. Not a webinar. A room full of people who do the work, willing to tell you where you're getting it wrong. The ROI isn't in what you learn. It's in who you come back as.
